Zoning Confirmation Letter

A letter from the Sudbury East Planning Board confirming whether a specific use is permitted on a specific property. Requests for Zoning Confirmation are typically made for purposes such as Ministry licensing, financing, and more.

Cancellation Certificate Application

In some cases, the original consent granted for a parcel of land may no longer be needed. For example, when a parcel created by consent needs to be adjusted for a driveway. In such cases, owners can apply for a certificate of cancellation, which effectively treats the parcel as though the previous consent had not been granted. This could result in the parcel merging with neighboring lands under the same ownership

Official Plan Amendment Application

The Official Plan guides development and land use in the Sudbury East Planning Area by establishing long-term goals, policies, and development strategies. Amendments to the Official Plan may be needed to:

  • Change the land use designation of a property.
  • Apply new policies or exceptions to existing policies for development that isn't permitted under the current Official Plan.

An Official Plan amendment may also require other approvals, such as a Zoning By-law amendment, before development can proceed.

Site Plan Control Application

A Site Plan Control Agreement describes the development requirements for a property. It includes plans, terms of the agreement, and financial guarantees to ensure compliance.

The purpose of Site Plan Control is to:

  • Improve the appearance of the town by applying consistent development standards.
  • Ensure off-street parking and loading facilities meet the town's requirements.
  • Ensure the safety and convenience of automobile and pedestrian traffic.
  • Enhance infrastructure systems through land easement dedications.

Consent/Severance Application

Land severance, often referred to as "consent," is required to subdivide land. Examples of cases where consent is required include (but are not limited to):

  • Dividing a single lot or parcel of land into two or more parcels.

  • Expanding a lot, making it larger than its current size.

  • Obtaining a right-of-way over an adjacent property for access.

Rezoning Application

Zoning by-laws regulate land use to ensure compatibility between developments. A rezoning application may be required if:

  • A proposed use is not permitted in the current zoning.
  • A proposed development cannot meet the existing zoning standards.

Rezoning is passed through a by-law by City Council. Since zoning implements the Official Plan, a rezoning application must conform to the Official Plan. If not, an Official Plan amendment may be necessary.

Minor Variance APPLICATION

Zoning by-laws regulate land development and use in the Sudbury East Planning Area. These by-laws cover aspects such as permitted land use, building locations, height, parking spaces, driveways, decks, and sheds. However, the by-laws cannot predict all situations, so the Committee of Adjustment may grant minor variances. These changes maintain the general intent of the Official Plan and Zoning By-law while addressing specific development needs.

Common types of requests for minor variance applications include (but are not limited to):

  • Increased building height
  • Increased lot coverage
  • Reduced parking requirements
  • Reduced yard setbacks (front, rear, or side)

Zoning Conformity Permit Application

Zoning Conformity Permits are issued in unincorporated/unorganized townships only if the proposal conforms to the Zoning By-law.

  • Approved by the Sudbury East Planning Board (Director of Planning).
  • Must comply with zoning regulations.
  • Processing time depends on the complexity of the proposal but typically takes only a matter of days.

Subdivisions

The creation of several lots requires the approval of a Plan of Subdivision. Applicants must pay a fee to the Sudbury East Planning Board to obtain comments on subdivision applications.

Part Lot Control

Part Lot Control under the Planning Act regulates the transfer or sale of parts of lots or blocks within a registered plan of subdivision. The Sudbury East Planning Board uses this provision to prevent further division of lots or blocks within a subdivision after registration.

Deeming By-law Application

A ‘deeming by-law’ removes lots or blocks from a registered plan of subdivision, provided the plan has been registered for more than eight years. The effect is to merge two or more lots into one legally conveyable parcel. Deeming by-laws are typically used to consolidate lots from old subdivisions that no longer meet current zoning standards.

Development Application – Validation of Tile Application

A certificate of validation is used to validate or correct a prior registered document such as a transfer of land or mortgage that breached the Planning Act as the required approvals under the Planning Act were received. Validation of title is not used to create new lots.
